The age–old dilemma of free will and determinism is attacked by proving that both sides are flawed with contingencies, that the notion of eternal law is a theologically tainted projection rather than a reality of the real world that is understood to be evolutionary. Determinism is dissolved into conditionalism. This excludes materialistic scientific explanation of the deterministic style. As it brings forth freedom, evolutionary reality transcends essentially the explanatory possibilities of statistically structured natural laws. Evolution has become the standard way of understanding the world process. Theology has to express traditional faith in the context of the contemporary world. Since the common world view has profoundly changed, from a static world of being into a dynamic world of becoming, theology needs to change its language and its understanding of the universe as God's creation. This understanding of an evolving world is to be used as a theological source. Such a change of perspective necessitates a fundamental (...) reconstructing of theology; for theology, such reconstructing means a renewed understanding of the Creator and of the Incarnation. The aim of this thematic literature review is to explore nurses' perceptions of ethical issues in the care of older people. Electronic databases were searched from September 1997 to September 2007 using specific key words with tight inclusion criteria, which revealed 17 primary research reports. The data analysis involved repeated reading of the findings and sorting of those findings into four themes. These themes are: sources of ethical issues for nurses; differences in perceptions between nurses and patients/relatives; nurses' personal responses (...) to ethical issues; and the patient—nurse relationship. The findings reveal that ageism is one of the major sources of the ethical issues that arise for nurses caring for older people. Education and organizational change can combat ageist attitudes. Wider training is required in the care of older people, workplace skills, palliative care and pain management for older people. The demands of a changing global demography will necessitate further research in this field. (shrink)

The impossibility of predicting the future allows us only to indicate which theological developments seem to be needed. These developments concern our changing perception of the world, which requires a reversal in our understanding of God's Creation, from its most imperfect beginnings to its unforeseeable future. The passing of evolution from the biological to the human level has opened moral dimensions that must be explored. Rather than return to the beginnings of the church, theology needs to try to understand Christian (...) faith within evolution, to reinterpret the past in the light of the new. In evolution, no final doctrine is possible. The necessity for doctrine creates a constant tension with the necessity of its revision. New truth must be paid for by suffering. The need is for a coherent theological vision of Creation, Redemption, and God's action in the world. Teilhard's metaphysics of union may be the key to it. In this view love becomes the central force of creation, which in Teilhard's view opens into an eternal future in God: in its final stage, evolution becomes Christogenesis. (shrink)

BackgroundBiobanking biospecimens and consent are common practice in paediatric research. We need to explore children and young people’s (CYP) knowledge and perspectives around the use of and consent to biobanking. This will ensure meaningful informed consent can be obtained and improve current consent procedures.MethodsWe designed a survey, in co-production with CYP, collecting demographic data, views on biobanking, and consent using three scenarios: 1) prospective consent, 2) deferred consent, and 3) reconsent and assent at age of capacity. The survey was disseminated (...) via the Young Person’s Advisory Group North England (YPAGne) and participating CYP’s secondary schools. Data were analysed using a qualitative thematic approach by three independent reviewers (including CYP) to identify common themes. Data triangulation occurred independently by a fourth reviewer.ResultsOne hundred two CYP completed the survey. Most were between 16–18 years (63.7%, N = 65) and female (66.7%, N = 68). 72.3% had no prior knowledge of biobanking (N = 73).Acceptability of prospective consent for biobanking was high (91.2%, N = 93) with common themes: ‘altruism’, ‘potential benefits outweigh individual risk’, 'frugality', and ‘(in)convenience’.Deferred consent was also deemed acceptable in the large majority (84.3%, N = 86), with common themes: ‘altruism’, ‘body integrity’ and ‘sample frugality’. 76.5% preferred to reconsent when cognitively mature enough to give assent (N = 78), even if parental consent was previously in place. 79.2% wanted to be informed if their biobanked biospecimen is reused (N = 80).ConclusionProspective and deferred consent acceptability for biobanking is high among CYP in the UK. Altruism, frugality, body integrity, and privacy are the most important themes. Clear communication and justification are paramount to obtain consent. Any CYP with capacity should be part of the consenting procedure, if possible. (shrink)

Constitutional review was the most original idea stemming from the Austrian Federal Constitution of 1920. It is argued that the politician Karl Renner gave birth to the idea of a constitutional court. Hans Kelsen played the predominant role in the drafting of constitutional provisions. The new Constitutional Court provided for a centralized system of review, with an eye to a number of politically important issues. Owing to the pressure that stemmed from various discussions between and among the politicians of (...) the national state and the Länder, Kelsen was obliged to depart from the German model of the federal state and to develop in its place a new theory. September 2001, von Beslan, Abu Ghraib und Kana ist das Interesse "am Bösen"wiedererwacht. Dabei fällt auf, dass die in Politik und Gesellschaft erfolgten Deutungen des Bösen geprägt sind durch klare Grenzziehungen zwischen "gut"und "böse", die zunehmend auch auf religiöse Kategorien wie Licht-Finsternis, gerecht-sündig, Tod-Leben rekurrieren. Dies provoziert die Frage nach der Trennschärfe von "gut"und "böse": Wo genau verläuft die Grenze zwischen "gut"und (...) "böse"und wer zieht diese Grenze? Ist "das Böse"eine unabhängige Größe oder tritt es vielmehr in Vermischung mit "dem Guten"auf? En este artículo exponemos las intuiciones del teólogo y biólogo alemán Karl Schmitz-Moormann sobre la evolución. Como leitmotiv subyacente en toda su obra, Schmitz-Moormann tiene a Teilhard de Chardin. Inspirado por Teilhard y su metafísica de la unión, introduce un nuevo concepto, a saber, la uni-totalidad. Veremos aquí cómo Schmitz-Moormann observa diversas uni-totalidades a lo largo del progreso evolutivo, desde las partículas subatómicas hasta las agrupaciones humanas. Esas diversas uni-totalidades implican, a la vez, diversidad de unión, (...) que puede ser explicada por causas que van desde la interacción nuclear hasta el amor interpersonal. Karl Schmitz‐Moormann argues that the doctrines of God and Creation, usually explicated in Roman Catholic theology by using the analogy of being, must rather be conceived in light of evolution and an analogy of becoming. God the Trinity, characterized by unity, information, and freedom, provides the image toward which the creation tends in its evolutionary processes. ArgumentThe paper is based on a hitherto unexplored document (audiotape of an interview accompanied by a German transcript) from 1953, located in the Freud Papers at the Library of Congress. It contributes to a better understanding of the impact of Freud and of Psychoanalysis on personalities from the exact sciences, here represented by the noted applied mathematicians Richard von Mises and Hilda Geiringer from Vienna. The detailed discussion of the interview sheds some new light on the different roles of Kraus (...) and Freud in the Vienna culture, on the Vienna Jugendkulturbewegung (youth culture movement) during WWI in which Geiringer was involved, on Freud’s and Siegfried Bernfeld’s standing around 1930 among German philosophers and psychologists, and on Wilhelm Fließ’ theory of periodicity, which von Mises—based on his attitude as an applied mathematician—defended against superficial accusations. Finally, new biographical material is provided for von Mises and the remotely related Freud family, and for Geiringer’s and von Mises’ early lives. The interview, which was taken during the Cold War, also allows conclusions as to how politics influenced the memories and views of the participants. Part of the aim of the paper is historical documentation of unknown material (letters by Karl Kraus and Wolfgang Köhler, one book review by Wilhelm Ostwald, a file on Richard Pfennig), including some correction of erroneous information in the literature. BackgroundThe theory and practice of ethics consultations (ECs) in health care are still characterized by many controversies, including, for example, the practice of giving recommendations. These controversies are complicated by an astonishing lack of evidence in the whole field. It is not clear how often a recommendation is issued in ethics consultations and when and why this step is taken. Especially in a facilitation model in which giving recommendations is optional, more data would be helpful to evaluate daily practice, ensure (...) that this practice is in line with the overarching goals of this approach and support the development of standards.MethodsWe analyzed all consultations requested from an EC service working under a facilitation approach at a maximum-care university hospital in Germany over a period of more than 10 years. Our aim was to better understand why—and under what circumstances—some consultation requests result in a recommendation, whereas others can be sufficiently addressed solely by facilitated meetings. We especially wanted to know when and why clients felt the need for clear advice from the EC service while in other cases they did not. We compared ethics consultations in terms of the differences between cases with and without recommendations issued by the ethics consultants using χ2 difference tests and Welch’s t-test.ResultsA total of 243 ECs were carried out between September 2008 and December 2019. In approximately half of the cases, a recommendation was given. All recommendations were issued upon the request of clients. When physicians asked for an EC, the consultation was significantly more likely to result in a recommendation than when the EC was requested by any other party. ECs in cases on wards with ethics rounds resulted in comparably fewer recommendations than those in wards without ethics rounds. When interpersonal conflicts were part of the problem or relatives were present in the meeting, clients less frequently asked for a recommendation.ConclusionFrom the client’s point of view, there does not seem to be only one “right” way to provide ethics consultations, but rather several. While facilitated meetings are obviously appreciated by clients, there also seem to be situations in which a recommendation is desired (especially by physicians). Further empirical and theoretical research is needed to validate our single-center results and re-evaluate the role of recommendations in ethics consultations. (shrink)

The issues involved in deciding whether to use artificial methods of delivering hydration and nutrition are often very difficult for patients, families, and health care providers. Once private and personal matters, these decisions now frequently involve the judicial system. Five years ago, Hospice of Washington recognized the need for a written policy and wrote the one published here. Its goal is to respect individual preferences and family concerns while addressing the nutrition and hydration needs of dying patients. The resolution of ambiguities is one of the central problems for Machine Translation. In this paper we propose a knowledge-based approach to disambiguation which uses Description Logics (dl) as representation formalism. We present the process of anaphora resolution implemented in the Machine Translation systemfast and show how thedl systemback is used to support disambiguation.The disambiguation strategy uses factors representing syntactic, semantic, and conceptual constraints with different weights to choose the most adequate antecedent candidate. We show how these factors can be (...) declaratively represented as defaults inback. Disambiguation is then achieved by determining the interpretation that yields a qualitatively minimal number of exceptions to the defaults, and can thus be formalized as exception minimization. Much has been written on Claude Bernard as a relentless promoter of the experimental method in physiology. Although the paper will touch Bernard’s experimental intuitions and his experimental practice as well, its focus is slightly different. It will address the laboratory, that is, the space in which experimentation in the life sciences takes place, and it will analyze the scattered remarks that Bernard made on the topic both in his books and in his posthumously published writings. The paper is divided (...) into four parts. The introduction briefly sketches the coming into being of the physiological laboratory in the first half of the nineteenth century. The second section will give an overview of Claude Bernard’s own itinerary in physiology and his personal laboratory experience. The third part of the paper will have a look at the image of the laboratory that Claude depicted in his Introduction to Experimental Medicine. In the subsequent section and by contrast, the image of the laboratory will come into focus as it can be reconstructed from Bernard’s notebook that he kept between 1850 and 1860, the Cahier rouge. Finally, the fifth part of the paper will spotlight Claude Bernard’s comparison of the sciences and the arts and their respective practices. A brief concluding statement tries to summarize Bernard’s epistemological position toward experimentally practiced science. (shrink)

Die gegenwärtig zu beobachtende Betonung des Visuellen ist den modernen Informationsgesellschaften zutiefst inhärent, weil erstens jene schon von ihrem Begriff her Mediengesellschaften sind (insofern Information immer nur medial zugänglich ist) und weil zweitens insbesondere die technischen Massenmedien ganz wesentlich als Bildmedien Bedeutung erlangen. In der Folge dieser Entwicklung dürfte ganz allgemein die Erzeugung von Sinn zunehmend im Zusammenhang von Zeige- statt (nur) von Sprechhandlungen auftreten. Dem steht bisher eine mangelnde Bildkompetenz gegenüber sowohl seitens der Forschung wie auch der Laien. Der (...) Mangel, der seitens der Laien besteht, ist das prominente Thema der Visual Culture Studies, deren Vertreter den bisher unzureichend bemerkten ideologischen Charakter der visuellen Kommunikation innerhalb unserer Gesellschaft bewußt machen und neutralisieren wollen. In Reaktion auf den Mangel hinsichtlich der wissenschaftlichen Reflexion hat sich über die letzten beiden Dekaden hingegen der breit angelegte Versuch einer interdisziplinären Bildwissenschaft entwickelt. -/- Bevor wir die inneren Beziehungen zwischen Medien und Bildern genauer diskutieren, wollen wir in einem ersten Schritt kurz das Verhältnis von Visual Culture Studies und Bildwissenschaft beleuchten und uns in einem zweiten Schritt der eigenen historischen und theoretischen Annahmen versichern bzw. diese explizieren. In dem ausführlicheren dritten Abschnitt werden wir auf den Medienbegriff näher eingehen und dabei exemplarisch die Medientheorie von McLuhan skizzieren. In einem vierten Abschnitt möchten wir unsere Bildtheorie gewissermaßen im Kontrast zu den Annahmen der Visual Culture Studies skizzieren. Dies zusammengenommen wird uns den theoretischen Hintergrund für unsere zentrale These in Abschnitt fünf liefern, daß die Fähigkeit der Bildverwendung als ein anthropologisches Grundprinzip verstanden werden sollte, von dem auch die Herausbildung der Sprachfähigkeit abhängt. The increasing use of Artificial Intelligence for making decisions in public affairs has sparked a lively debate on the benefits and potential harms of self-learning technologies, ranging from the hopes of fully informed and objectively taken decisions to fear for the destruction of mankind. To prevent the negative outcomes and to achieve accountable systems, many have argued that we need to open up the “black box” of AI decision-making and make it more transparent. Whereas this debate has primarily focused on (...) how transparency can secure high-quality, fair, and reliable decisions, far less attention has been devoted to the role of transparency when it comes to how the general public come to perceive AI decision-making as legitimate and worthy of acceptance. Since relying on coercion is not only normatively problematic but also costly and highly inefficient, perceived legitimacy is fundamental to the democratic system. This paper discusses how transparency in and about AI decision-making can affect the public’s perception of the legitimacy of decisions and decision-makers and produce a framework for analyzing these questions. We argue that a limited form of transparency that focuses on providing justifications for decisions has the potential to provide sufficient ground for perceived legitimacy without producing the harms full transparency would bring. This paper explores how transformative experience generates decision-making problems of particular seriousness in medical settings. Potentially transformative experiences are especially likely to be encountered in medicine, and the associated decisions are confronted jointly by patients and clinicians in the context of an imbalance of power and expertise. However in such scenarios the principle of informed consent, which plays a central role in guiding clinicians, is unequal to the task. We detail how the principle’s assumptions about autonomy, rationality and information handle (...) transformative experiences poorly, appealing to several difficult cases for medical decision-making to illustrate the resulting problem, and we consider how the existing literature on complications with consent fails to offer a resolution. We argue that recognition of the problem has a role to play in achieving a more effective response to transformative decisions. In Sect. 1 we introduce several representative cases of challenging patient decision-making that clinicians might face. In Sect. 2 we detail how transformative experience has been analysed in the recent literature, before outlining in Sect. 3 the theoretical basis of the principle of informed consent, which plays a central role in how clinicians are expected to support decision-making. In Sect. 4, having laid the groundwork for a clear description, we return to the cases given in Sect. 1 to confirm how their transformative nature presents a problem: either clinicians treat the decisions faced by these patients as ‘normal’, encouraging them to focus on information provision that patients may be unable to act on, or they treat them as transformative, in which case they lack the resources to recognise whether they are helping patients make (subjectively) good decisions. In Sect. 5 we argue that the existing literature does not offer any escape from this problem. We close in Sect. 6 by noting the significant impact that appreciating the problem of transformative experience could have on supporting transformative decisions in medicine and briefly suggesting how we might aim to develop new approaches to dealing with these.
